Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the Gatezen mobile application and website (together, the "Platform"). By signing up or using the Platform, you agree to be bound by these Terms and our Privacy Policy.
Please read these Terms carefully. If you do not agree, please do not use the Platform.
1. Acceptance of terms
By accessing or using the Platform, you confirm that:
- You are at least 18 years of age, or your guardian has accepted these Terms on your behalf.
- If you are signing up on behalf of a Resident Welfare Association ("RWA"), housing society, or builder ("Society"), you have the authority to bind that Society to these Terms.
- The information you provide is true, accurate, and complete.
- You will keep your information up to date.
These Terms form a legally binding contract between you and Gatezen. The terms "we", "us", and "our" refer to Gatezen, the operator of the Gatezen Platform. The terms "you" and "user" refer to any individual or entity that uses the Platform.
2. Account registration
Resident, guard, family member, and renter accounts
- You access the Platform through your registered mobile number, verified by a one-time password (OTP).
- Your access is provided through the Society that subscribes to Gatezen. Your Society's admin onboards you by adding your name and number to their resident or guard list.
- You must keep your phone number current. If you change your number, you can update it from inside the app, with OTP verification on the new number.
Society admin accounts
- Society admins access a web dashboard at admin.gatezen.app using their email address and a password set by them.
- Admins are responsible for keeping their email and password confidential.
- If your Society's secretary changes, the outgoing admin should add the incoming admin through the dashboard's "Add Admin" function before stepping down. Once the new admin has access, the outgoing admin can be removed.
- If the outgoing admin is unavailable, the Society can email support@gatezen.app with the society resolution letter and we will assist with the handover.
Account security
- You are responsible for all activity under your account.
- Notify us immediately at support@gatezen.app if you suspect unauthorised access.
- Sharing your OTP code or password with anyone is strictly prohibited.
3. Services we offer
Gatezen provides a technology platform to manage entry, communications, and safety in housing societies. Our services include:
- Visitor Management — guards log visitors at the gate; residents approve or deny remotely.
- Pre-Approved Visitors — residents pre-approve regular service providers.
- Blacklist — residents block unwanted visitors from entry.
- Emergency SOS — residents alert guards and admin in emergencies (medical, fire, suspicious activity).
- Notices and Broadcasts — society admins communicate with residents and guards.
- Complaints — residents raise issues to the admin.
- Society Administration Dashboard — admins manage flats, guards, gates, view visitor logs, and run reports.
We may add, modify, or remove features at any time. We will provide reasonable notice of significant changes.
4. User roles and responsibilities
Society / RWA (our direct customer)
- Subscribes to Gatezen and pays applicable fees.
- Provides resident, guard, and flat information to enable onboarding.
- Obtains necessary consent from residents to share their information with Gatezen.
- Configures the platform (gates, building structure, admin access) for their society.
- Is responsible for the conduct of its admins and the security personnel it employs.
Society Admin
- Operates the dashboard on behalf of the Society.
- Adds/removes residents, guards, and gates.
- Sends broadcasts and notices.
- Reviews complaints and visitor logs.
- Must not use the platform to harass, defame, or unlawfully surveil residents.
Resident (Owner)
- Approves or denies visitors targeting their household.
- May add family members and renters to the flat. Family members and renters added by the owner are scoped to the owner's household.
- May add a renter to the flat. Once a renter is added, the renter has their own private household — visitor approvals, pre-approved list, blacklist, and emergency alerts are private from the owner.
- Manages society-level settings such as Do Not Disturb hours.
Resident (Renter)
- Approves or denies visitors targeting the renter household (themselves and their family members).
- May add family members under their own household. Renters cannot add other renters to the flat.
- Cannot see the owner's visitor approvals, pre-approved list, blacklist, or emergency alerts.
Family Member
- May approve or deny visitors targeting the household, based on permissions granted by the household primary (owner or renter).
- Sees information limited to the household they belong to.
Guard
- Logs visitors at the gate, including capturing visitor name, phone, vehicle, and (optionally) photo.
- Receives push notifications when residents approve or deny visitors.
- If a resident does not respond within the timeout window, the guard may step in to allow or deny the visitor with the residents consent (e.g. by phoning the resident).
- May trigger an SOS in case of suspicious activity, fire, or other emergencies.
- Must not log false entries or harass visitors.
Visitor
Visitors do not have an account on Gatezen. Their information is recorded by the guard at the gate, with their consent, and processed in accordance with our Privacy Policy. Visitors may request deletion of their information by emailing support@gatezen.app.
5. Fees and payments
Gatezen charges its direct customer (the Society) a subscription fee. Individual residents, guards, and family members are not charged for using the app.
- Fees, billing cycles, and payment terms are agreed separately between Gatezen and each Society.
- If a Society stops paying or terminates its subscription, all residents in that society lose access to the Platform.
- We do not offer refunds for partial billing periods, except where required by applicable law.
6. Prohibited conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable law.
- Harass, threaten, defame, stalk, or otherwise harm any other user.
- Log false visitor entries or impersonate another person.
- Upload viruses, malicious code, or content designed to disrupt the Platform.
- Reverse-engineer, decompile, or attempt to extract the source code of the Platform, except where permitted by law.
- Scrape, harvest, or collect information from the Platform using bots or automated tools.
- Bypass authentication, security, or rate-limiting controls.
- Use the Platform to send unsolicited commercial messages (spam) to residents.
- Sell, transfer, or sublicense your account to anyone.
- Submit content that is obscene, pornographic, paedophilic, defamatory, or that infringes another's intellectual property or privacy rights.
Violation of these rules may result in immediate suspension or termination of your access.
7. Suspension and termination
We may suspend or terminate your access to the Platform at any time, with or without prior notice, if:
- You breach these Terms or the Privacy Policy.
- We suspect fraudulent or illegal activity on your account.
- The Society you belong to terminates its Gatezen subscription.
- The Society admin removes you from the resident, guard, or admin list.
- We are required to do so by law.
You may stop using the Platform at any time. To delete your account, ask your Society admin to remove you, or email support@gatezen.app.
8. Intellectual property
The Gatezen Platform — including the mobile app, dashboard, source code, design, branding, logos, content, and documentation — is owned by Gatezen and is protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Platform for its intended purposes, subject to these Terms.
You may not:
- Copy, reproduce, modify, distribute, or create derivative works of the Platform.
- Use Gatezen's trademarks, logos, or branding without written permission.
- Remove or alter any copyright, trademark, or proprietary notices.
Content you submit (such as feedback, complaints, or your name and visitor information) remains yours, but you grant Gatezen a non-exclusive licence to use that content as needed to operate the service.
9. Third-party services and links
The Platform may integrate with or link to third-party services (such as Google Firebase, Expo push notifications, or your phone's dialer for calling residents). We are not responsible for the policies or practices of these third parties. Your use of those services is governed by their own terms.
10. Disclaimers and limitation of liability
"As is" service
The Platform is provided on an "as is" and "as available" basis. We do not warrant that the Platform will be error-free, uninterrupted, secure against all attacks, or free of viruses or harmful components.
Best-effort service
Gatezen is a technology platform. We provide the tools to help societies manage visitors and security, but we do not employ guards, admins, or any personnel at your premises. The actual security and safety of your apartment, society, or premises is the responsibility of your Society and the security personnel it employs.
Gatezen is not liable for:
- Theft, security breach, trespass, or any unusual or illegal activity that occurs in or around the premises.
- Acts or omissions of the Society's guards, admins, residents, or visitors.
- The accuracy of information entered by Society admins, residents, guards, or visitors.
- Loss of access to the Platform due to internet outages, device failure, app store removal, or third-party service disruption.
- Misuse of the Platform by another user.
Limitation of liability
To the maximum extent permitted by law, Gatezen, its directors, employees, agents, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business opportunities arising from your use of (or inability to use) the Platform.
Our total aggregate liability for any claim arising from your use of the Platform shall not exceed the fees actually paid by you (or by your Society on your behalf) to Gatezen in the 12 months prior to the claim.
Some jurisdictions do not allow exclusion of certain warranties or limitation of liability for incidental damages. In such cases, the limitations above apply only to the maximum extent permitted by law.
11. Indemnity
You agree to defend, indemnify, and hold harmless Gatezen, its officers, directors, employees, agents, and contractors from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:
- Your use of or access to the Platform.
- Your violation of these Terms or the Privacy Policy.
- Your violation of any third-party right, including intellectual property or privacy.
- Content you submit or actions you take through the Platform.
This obligation does not apply to claims arising from Gatezen's gross negligence, fraud, or wilful misconduct.
12. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will notify you through the app or by email to the address on file. The "Last updated" date at the top of this page indicates when these Terms were last revised. Your continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
13. Governing law and jurisdiction
These Terms are governed by the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Patna, Bihar, India.
